The Napa County District Attorney's Office said that Paul Pelosi, who is married to House Speaker Nancy Pelosi, is scheduled to be arraigned Wednesday morning.
It is on charges of driving under the influence (DUI) of alcohol causing injury and driving with .08% blood alcohol level or higher causing injury, reported Fox News. The charges are related to a collision that happened on May 28. Around 10 p.m. that evening, a 2014 Jeep struck Paul's 2021 Porsche at an intersection. Paul was driving his car eastbound on Walnut Lane. He tried to cross State Route 29, but then his vehicle was struck by a westbound Jeep. It was driven by Jesus V. Lopez, the Napa County District Attorney's Office said.
At the time, Paul, 81, allegedly had a blood alcohol content level of .082%. It was revealed after a sample was taken about two hours after the crash. The collision injured the 48-year-old Calistoga man, Sfgate reported.
Misdemeanor charges were filed "based upon the extent of the injuries suffered by the victim," said the district attorney. It's not clear what those injuries are and the person driving the Jeep was not arrested.
The matter is scheduled to be heard in Napa County Superior Court at 8.30 a.m. Wednesday and will be streamed on Zoom. The arraignment includes a formal reading of the charges, and the judicial officer will also confirm that the defendant is charged with the correct name.
Paul or his defense counsel is scheduled to enter a plea at the arraignment on Wednesday. Kron4 reported that defendants may appear through their lawyer for misdemeanor DUI cases, according to California Penal Code section 977. It means that they don’t need to be physically present in the court unless a judicial officer orders it. Paul was not ordered to appear.
When charges were filed in June the punishment for DUI causing injury as a misdemeanor "includes up to five years of probation, said the district attorney. Other punishments include a minimum of five days in jail, fines and fees, installation of an ignition interlock device and "completion of a court ordered drinking driver class, and other terms as appropriate."
