A convicted sex offender who was recently paroled for an attempted rape case in 1997 was arrested yet again on Wednesday, Dec. 22, for raping a woman in a construction site in Chelsea, New York.
The 61-year-old Darryl Phelps was found brutally assaulting a 23-year-old Asian woman under scaffolding in West 28th Street on Wednesday. Police had to physically drag Phelps away from the victim as he kept her restrained to the ground while he violated her, New York Post reported.
“I want you to have my baby,” he reportedly told the victim as he raped her.
The woman was returning to her home from work at a local restaurant when Phelps attacked and punched her, bruising her right eye. The woman was taken to Lenox Health Greenwich Village after the sexual assault, according to the New York Daily News.
“This was a savage and brutal attack of an innocent woman on her way home from work,” a police officer said regarding the case. “He is a sexual deviant who should not have been released under any circumstances.”
Phelps has a history of rape and sexual assault. He spent over 23 years in prison for the 1997 attempted rape of a woman that he followed to her home on the day that he was paroled for a different crime. Because of this, he is listed as a sexually violent offender on the Sex Offenders Registry.
The crime he was paroled for in 1997 was for attempted burglary, for which he was convicted in 1987, the same year he was paroled after two years for a different attempted robbery conviction.
He reportedly had been attempting to get his parole approved since 2019, despite the parole board citing his history of misbehavior and his 1997 attempted rape that happened the same day he was released. He was finally released on September 2021.
He will be charged with rape, criminal sex act, sex abuse, and assault with a likelihood of spending the rest of his life in prison.
