New findings from an independent investigation into the conviction of Richard Glossip, an Oklahoma death row inmate, have emerged.
And now, at least one Republican legislator is calling for the end of the state's use of capital punishment if the prisoner is put to death, reported CNN. Investigators said Wednesday that the inquiry showed that Glossip's case was marred by "inexcusable conduct by prosecutors".
Attorney Stan Perry with the law firm Reed Smith, which conducted the investigation, said that their conclusion is that "no reasonable jury, hearing the complete record and the uncovered facts detailed in this report, would have convicted Richard Glossip of capital murder." A legislative committee of 34 state lawmakers, including 28 Republicans, commissioned the report. They expressed concern about the case against the inmate, a motel manager who is convicted of murder in the 1997 death of Barry Van Treese.
Republican state representative and committee member Kevin McDugle said at a Wednesday news conference that the investigative report confirmed in his mind that "we do have an innocent man on death row."
Another motel employee, then-19-year-old Justin Sneed, who worked as maintenance worker, physically killed Van Treese with a baseball bat, prosecutors in Glossip's case acknowledged. But they told jurors that Sneed did so in a murder-for-hire scheme that was masterminded by Glossip. Sneed got a life sentence in a plea deal for his testimony against Glossip. The new report said that it was the only evidence tying Glossip to the murder.
Perry said that they know who the murderer is, and yet "somebody is on death row that's not the murderer."
McDugle said that he is a supporter of the death penalty. But he believes that this case shows weaknesses in the reliability of capital prosecutions. He said that if Glossip ia put to death, he will "fight in this state to abolish the death penalty simply because the process is not pure."
According to Sky News, McDugle, said that they've got a person "sitting on death row that has been there 25 years, and I believe he's totally innocent."
The 59-year-old prisoner has been convicted twice and sentenced to death for ordering the killing of his boss. Mirror reported that Oklahoma County District Attorney David Prater had said that he was reviewing the report. He previously believed that Glossip was guilty after reviewing items of evidence.
