Diego Cruz Alonso, one of the four young men being accused of raping teen Daphne Fernández, could be taking advantage of his dual citizenship to delay his extradition to Mexico, sources revealed on Wednesday.
According to Cristina Oropeza, spokesperson for the Mexican Secretariat of Foreign Affairs, Cruz Alonso could use his Spanish nationality to request asylum, and potentially ask to be judged in Spain instead.
“The first thing that we have to make clear here is that we are dealing with someone who has a dual citizenship,” Oropeza told Grupo Fórmula’s Ciro Gómez Leyva. “This is a case of excessive consular protection.”
She continued, “Our embassy spoke to his dad, he called our emergency line and asked for information about legal procedures in Spain. We provided the information for him.”
Oropeza added that the Cruz Alonso family has yet to make the request official in order to continue with the process.
“If they decide to make the request, they would have to go through Spanish authorities,” she explained. “If he were to proceed with this approach, the consul would have to arrange a meeting in which we would explain the case, and the final decision would be up to him.”
The Interpol confirmed Cruz Alonso’s arrest last Friday. The young man was detained in Madrid, Spain, despite trying to mislead officials and denying he was the boy in the pictures. His identity was confirmed around 9:00 p.m.
Enrique Capitaine, who has been identified as the main aggressor and has been charged with aggravated child abuse, remains without privileges at the La Toma prison in Amatlán de Los Reyes. His father, Enrique Capitaine, continues his fight to prove his son’s innocence.
Capitaine, Cruz Alonso and Jorge Cotaita, who is still at large, are being accused of allegedly kidnapping Daphne after a party and sexually assaulting her at a house in Boca del Río, Veracruz, Mexico.
