Former “The Walking Dead” showrunner Frank Darabont’s $300-million lawsuit against AMC gets heated after AMC’s representative, Orin Snyder, sent a letter to Judge Coen last Monday. Darabont’s current “Audit” case — filed in January 2018 — and “License Fee” case — actioned 2013 — have yet to conclude as both parties refuse to give leeway.
“Defendants have struck a raw nerve by exposing fundamental flaws in Plaintiffs’ case. Kinsella does not want Defendants to probe his clients’ contradictory positions on the [modified adjusted gross receipts] definition,” wrote Snyder in his letter. “Even more, he does not want Defendants to expose the egregious conflict of interest between Darabont and his agents at CAA. The dirty secret in Hollywood is that talent agencies often sell their clients down the river in exchange for bigger packaging fees for themselves.”
This new tactic employed by AMC seeks to put a rift between Darabont and Creative Artists Agency (CAA) in hopes of providing a contradictory stance from Darabont’s party. The channel’s representatives even attacked Dale Kinsella, Darabont and CAA’s lead attorney, describing his actions as “improper and obstructive deposition conduct.” This was in response to Kinsella “shutting down” the questioning of the witnesses in relation to CAA’s profit participation.
“AMC’s transparent effort to mask their own outrageous and harassing deposition conduct by filing an at best misleading letter directly with the court is yet another publicity stunt,” replied Kinsella, after news of AMC’s letter was made public.
Kinsella lashed back at AMC, saying that the channel is merely “delaying” by creating “sham” disputes. Kinsella pointedly stated that AMC is merely using this argument as a smokescreen, with AMC “obsessing” about everything else aside from their own “despicable” behavior.
“We are optimistic the court will see through Mr. Snyder’s specious arguments and keep the parties on track for the scheduled trial,” Kinsella stated confidently.
The legal proceedings are set for May 2020. As the situation keeps escalating, both parties keep their fangs bared in order to assert dominance in the case. As of this writing, AMC has yet to comment on Kinsella’s reply.
