Border Czar Tom Homan warned on Tuesday that the Maryland man who was wrongfully deported to El Salvador will be removed from the U.S. again if "somehow he comes back."
"Every time I read a story about him they say 'Maryland father,' they don't mention he's a member of MS-13, a designated terrorist organization," Homan said in an interview on Fox News, making reference to Kilmar Abrego Garcia. His family and attorneys have firmly rejected he is a part of MS-13.
Homan went on to say that news reports "don't mention he's a Salvadoran citizen being held by the country of El Salvador. El Salvador makes that decision. Now the court says we have to 'facilitate.' We'll do it but if somehow that he comes back and that happens, he's gonna be detained and removed again ... what's the sense of bringing someone back who's simply going to face deportation again?" the official added.

"He's a public safety threat, he's a gang member, he's a designated terrorist. We should not be bringing any of those people back to the U.S." Homan claimed. His statement came shortly before the Department of Justice appeared before the judge who has asked for daily updates regarding the fate of Abrego Garcia, saying that if he manages to return "DHS would take him into custody in the United States and either remove him to a third country or terminate his withholding of removal because of his membership in MS-13."
DOJ provides no new information on Abrego Garcia but says if he manages to return to the US, they'll detain him and remove him to a different country (not El Salvador) or seek to "terminate" his order of removal and send him back to El Salvador...

The case of Abrego Garcia is dominating headlines as a result of the Trump administration's reluctance to comply with the Supreme Court ruling requiring it take steps to bring him back, as well as the visit by Salvadoran President Nayib Bukele to the White House on Monday.
Speaking to press, Bukele said he has no intention nor the authority to return Abrego Garcia, deported despite a 2019 court order barring his removal to El Salvador, country he fled in 2011. "How can El Salvador return him to the United States? By smuggling him? Of course we're not going to do that. I don't have the authority to return him," Bukele, a Trump ally, said.
Attorneys for Abrego Garcia said on Tuesday the Trump administration has to "at least be required to request" his release to honor the Supreme Court's ruling on the matter.
In a court document, the attorneys also disputed the government's argument that it lacks authority to secure Abrego Garcia's return, pointing to an ICE policy that requires DHS supervisors to "fully coordinate the...international...level to facilitate the return of removed individuals."
The document also criticizes the government for not complying with a court order requiring it "take all available steps to facilitate the return of Abrego Garcia to the United States as soon as possible," arguing that its updates "do not indicate that any steps have been taken to comply with this Court's and the Supreme Court's orders." The White House, however, has shown no signs of intending to comply with the rulings.
